1. OUR COMMERCIAL POLICY

The Seller offers products for sale on calzatureginevra.it and carries out its e-commerce activity exclusively towards its end users who are "consumers".

When we refer to "consumer", we mean any natural person who acts on calzatureginevra.it for purposes unrelated to their commercial, entrepreneurial or professional activity, if any. The General Conditions of Sale do not, however, regulate the provision of services or the sale of products by subjects other than the Seller who are present on calzatureginevra.it through links, banners or other hyperlinks. We advise you, before placing orders and purchasing products and services from subjects other than the Seller, to check their conditions of sale, because the Seller is not responsible for the provision of services by third parties other than the Seller or for the conclusion of e-commerce transactions between users of calzatureginevra.it and third parties.
Following BREXIT, for purchases made outside their economic community, UK customers will be asked to bear customs duties in order to collect the goods. The price paid to Calzature Ginevra therefore includes the price of the purchased goods plus shipping costs. Calzature Ginevra has no control over customs duties and cannot know their amount; they are imposed and collected exclusively by customs itself. Should a customer decide not to accept the goods on delivery because they do not wish to bear the customs duties, the amount of customs duties that Calzature Ginevra will be forced to bear on import will be withheld from the refund upon return of the goods. The same conditions regarding the payment of customs duties are obviously valid for all countries that are not part of the European Economic Community.
2. HOW TO CONCLUDE THE CONTRACT WITH CALZATURE GINEVRA
2.1
To conclude the contract for the purchase of one or more products on calzatureginevra.it, you will need to fill out the order form in electronic format and transmit it to the Seller, electronically, following the relevant instructions.
2.2
The order form contains a reference to the General Conditions of Sale, and a summary of information on the essential characteristics of each ordered product and its relative price (including all applicable taxes), the payment methods you can use to purchase each product and the delivery methods of the purchased products, shipping and delivery costs, a reference to the conditions for exercising your right of withdrawal and the methods and times for returning the purchased products.
2.3
The contract is concluded when the Seller receives your order form electronically, after verifying the correctness of the data related to your order.
2.4
Before proceeding with the purchase of the products, by transmitting the order form, you will be asked to carefully read the General Conditions of Sale and the Information on the right of withdrawal, to print a copy using the print command and to store or reproduce a copy for your personal use.
2.5
The order form will be archived in our database for the period of time necessary to process the orders and, in any case, within the terms of the law. You can access your order form by consulting the "My order" section.
2.6
Before submitting the order form, you will also be asked to identify and correct any data entry errors.
2.7
The language available for concluding the contract with the Seller is Italian.
2.8
Once the contract is concluded, CALZATURE GINEVRA will process your purchase order.
2.9
The Seller may not process your purchase orders that do not provide sufficient guarantees of solvency or that are incomplete or incorrect, or in case of unavailability of the products. In these cases, we will inform you by email that the contract is not concluded and that the Seller has not processed your purchase order, specifying the reasons. If the products presented on calzatureginevra.it are no longer available or for sale at the time of your last access to the site or sending the order form, the Seller will promptly notify you, and in any case within thirty (30) days from the day following the day on which you transmitted your order to the Seller, of any unavailability of the ordered products. In case of forwarding the order form and payment of the price, the Seller will refund what you have already anticipated.

By electronically transmitting the order form, you unconditionally accept and undertake to observe, in your dealings with the Seller, these General Conditions of Sale. If you do not agree with some of the terms reported in the General Conditions of Sale, we invite you not to submit the order form for the purchase of products on calzatureginevra.it.

By transmitting the order form, you confirm that you know and accept the General Conditions of Sale and the additional information contained on calzatureginevra.it, also referred to by links, including the General Conditions of Use, the Privacy Policy and the Information on the right of withdrawal.

Once the contract is concluded, the Seller will send you, by email, a receipt of the purchase order, containing a summary of the information already contained in the order form (General Conditions of Sale, Information on the right of withdrawal, information on the essential characteristics of the product and detailed indication of the price, payment methods and delivery costs).
3. GUARANTEES AND INDICATION OF PRODUCT PRICES
3.1 Only luxury brand and first quality products are offered for sale on calzatureginevra.it. These products are purchased directly by the Seller from fashion houses, manufacturers and retailers carefully selected for their rigorous quality controls.
3.2 The Seller does not sell used or irregular products or products of lower quality than the corresponding standards offered on the market. Only vintage items that are offered for sale in the specific section of calzatureginevra.it, due to their particular nature, may be used and/or in conditions of obvious wear. In the description of each vintage product, CALZATURE GINEVRA will take care to specify the conservation conditions of the item presented if they differ from the standards offered on the market.
3.3 The essential characteristics of the products are presented on calzatureginevra.it within each product sheet. However, the images and colors of the products offered for sale on calzatureginevra.it may not correspond to the real ones due to the Internet browser and monitor used.
3.4 Product prices may be subject to updates. Please check the final sale price before submitting the relevant order form.
3.5 Purchase requests from countries not included among those displayed on the splash page cannot be accepted by the Seller.
3.6 All products are provided with an identification tag fixed with a single-use seal. We ask you not to remove the tag and the relative seal from the purchased products, of which they constitute an integral part.
3.7 The Seller, in case of exercise of your right of withdrawal, has the right not to accept the return of products that are without the relative tag or that have been altered in their essential and qualitative characteristics or that have been damaged.
4. PAYMENTS
4.1 To pay for the price of the products and the related shipping and delivery costs, you can follow one of the methods indicated in the order form.
4.2 In case of payment by credit card, financial information (e.g. credit/debit card number or its expiry date) will be forwarded, via encrypted protocol, to PayPal, which provides the related remote electronic payment services, without third parties being able to access it in any way. Furthermore, such information will never be used by the Seller except to complete the procedures relating to your purchase and to issue the related refunds in case of any returns of products, following the exercise of your right of withdrawal, or if it is necessary to prevent or report to the police the commission of fraud on calzatureginevra.it. The price for the purchase of the products and the shipping and delivery costs, as indicated in the order form, will be charged to your current account at the time of shipment of the purchased products.
4.3 If you buy with Scalapay, you receive your order immediately and pay in 3 installments. You acknowledge that the installments will be assigned to Incremento SPV S.r.l., to related parties and to their transferees, and that you authorize such assignment.
5. DISCOUNT COUPON CODES
Discount coupon codes (2) can only be used by creating an account and registering on the website (LOGIN) or subscribing to the newsletter. Coupons cannot be combined with each other. To use each coupon, it is mandatory to log in/access the site, and its use is limited to one order per user, identified by: tax code or user account or email. Where specified, discount coupon codes cannot be combined with other ongoing promotions.
6. Shipping and delivery of products
6.1 To find out the specific shipping and delivery methods for products, access the Shipping section within the Customer Service area. Please pay attention to what is reported in this section because the indications contained therein form an integral and substantial part of these General Conditions of Sale and, therefore, are considered by you to be fully known and accepted at the time of transmission of the order form.

8. Right of withdrawal
You have the right to withdraw from the contract, without stating your reasons, within 14 days. The withdrawal period expires after 14 days from the day on which you or a third party, other than the carrier and designated by you, acquires physical possession of the last good. To exercise the right of withdrawal, you are required to inform us (CALZATURE GINEVRA SRL, VIA CASE NUOVE 25/D, 61041 ACQUALAGNA, 0722 88481, shop@calzatureginevra.it) of your decision to withdraw from this contract by means of an explicit statement, to be sent by email to our aforementioned email address. For this purpose, you can use the attached standard withdrawal form, Download the RETURN FORM but it is not mandatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired. The withdrawal must always be communicated via email; before shipping the return, wait for our acceptance of the return itself and confirmation of the return address between the two operative ones.
9. Effects of withdrawal
If you withdraw from this contract, all payments you have made to us will be reimbursed without undue delay and in any case no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. These refunds will be made using the same means of payment that you used for the initial transaction, unless you have expressly agreed otherwise; in any case, you will not incur any costs as a consequence of such reimbursement. The reimbursement may be suspended until receipt of the goods. The direct costs of returning the goods will be borne by you. You are only responsible for the diminished value of the goods resulting from the handling of the goods other than what is necessary to establish the nature, characteristics and functioning of the goods.
